Rollover Accidents

A rollover accident is defined as a crash where the impact forces the vehicle onto its side or roof. Rollover accidents are not the most common type of accident, but they are especially dangerous. According to the Insurance Institute for Highway Safety, over 30 percent of vehicle occupant deaths in 2020 occurred in rollover accidents.

When a car rolls over, the impact of the roof of the vehicle can collapse and inflict serious head injuries. This makes
rollover accidents a serious risk for injuries and fatalities in comparison to crashes which impact the front, side or rear of the vehicle.

Rollover accident deaths are more common for single-vehicle crashes, which accounted for 50 percent of vehicle occupant fatalities, compared to 13 percent for multiple-vehicle crashes.

What are the Causes of Rollover Accidents?

There are two classifications of rollover accidents, tripped and untripped.

An untripped rollover accident occurs without any interference from another vehicle or object. When a vehicle turns a corner, sudden increases in force from the tires, inertia and gravity may cause the vehicle to tip and rollover.

A tripped rollover is caused by a change in surface or a collision with another vehicle, or an object. The most common scenario for rollovers in single vehicle accidents is when a car’s tires hit a curb or a soft surface on the shoulder. The abrupt escalation in lateral force causes the rollover. A rollover can also occur when a car collides with another vehicle or object, such as a guardrail, that forces one side of the vehicle upward, and the instability pushes the car up and sideways. If a car is struck in a side collision, that force can also be strong enough to cause a rollover.

Who is Liable in a Rollover Accident?

In a personal injury lawsuit, the party whose negligence caused the accident is liable for the victim’s damages. In some cases, it is clear which party was negligent – for example, if the victim collided with another vehicle that was being driven recklessly, the other driver is liable. But what about other kinds of rollover accidents?

  • A negligent driver whose behavior could cause an accident. A rollover can occur when a driver has to maneuver to avoid a crash with another driver who is speeding, driving while distracted or drunk driving.
  • County or local government. When driving conditions change, drivers are expected to adjust so they can do so safely. However, if the authority responsible for maintaining a road has left unexpected hazards or not put up adequate signage, they may be held liable for a rollover accident.
  • The car’s manufacturer. If the rollover was caused by an unknown mechanical fault – for example, a part under recall – the manufacturer may be held liable.

What Kind of Injuries are Caused By Rollover Accidents?

What Kind of Injuries are Caused By Rollover Accidents?

  • Broken bones
  • Spinal injuries
  • Concussion
  • Traumatic brain injury
  • Internal injuries

Injuries caused by a rollover accident will likely require extensive treatment and recovery time. A personal injury lawsuit can help the victim recover their costs.

Treatment for injuries caused by a rollover accident will result in ongoing medical bills that can run into hundreds of thousands of dollars. A personal injury lawyer helps their client collect damages to cover emergency room treatment, surgeries, short or long-term hospital stays, prescription drugs, physical therapy, and assistive devices.

Taking the necessary time to recover from injuries means lost income. A rollover accident victim is entitled to compensation from taking time off work while recuperating and/or attending follow-up doctor or physical therapy appointments. In some cases, an accident victim will be permanently disabled and unable to return to their job because of the extent of their injuries.

A rollover accident can cause extensive property damage. The impact of the crash will likely make the victim’s car a total write-off and need replacing, and the victim is entitled to the car’s value and the costs of a rental car.

The experience of a rollover accident can cause severe physical pain and mental and emotional stress. These damages are classified as pain and suffering. A claim for these kinds of damages compensates the victim for the loss of enjoyment of their daily life.

I was referred by a friend to Eric Frobish, when going through a divorce and I am glad I took this advice. From the day of the consultation to the day the divorce was finalized, I was patiently walked through the entire process and kept up to date throughout the entire process. Eric is very straight-forward, down to earth and knowledgeable in regards to divorce and child custody. Eric’s assistant, Sarah is also very kind and helpful. Divorce is a very stressful situation and Eric and Sarah made the process and transition so much easier. I would highly recommend Eric to anyone in need of a divorce or child custody attorney, as you will not be disappointed!

I was recently divorced on 03~01~16. My case was taken care of in a real professional and private manner. I can remember when I talked to my counsel on the telephone for a consultation. He had patience with me, even though I had a real hard time telling my story without crying. My story was a little terrifying to tell to another person, but Mr. Frobish was a good listener. I had been looking for legal help for a while. There was a lot of suffering all the while. I still go to meetings for mental and physical abuse. I substained very bad physical abuse, close to death. My former husband was/is a career criminal and still on the run. Mueller, Lawson & Frobish, P.C. took care of my divorce and they were very kind and caring and also showed me respect. Everyone in the firm did a great job in keeping me informed on the progress they were making on my case. I would definitely recommend this law firm to anyone. I again just want to thank you so much for taking care of my divorce. Forever thankful – Vickie Sue Crumb

I am a devoted father who was seeking a shared custody 50/50 parenting time of my now 4 year old son. I asked around for a good attorney and I was referred to Eric Frobish. During my consultation with Mr. Frobish, I felt he was honest and straight forward with my case. Today I have shared custody of my son. I was very pleased with the outcome of my case and I have Mr. Frobish to thank! Mr. Frobish continues to represent me so I can maintain my 50/50 parenting time. I would highly recommend Mr. Frobish.

Mueller, Lawson & Frobish, P.C. is an excellent Law Firm located in Morris Illinois. Specifically, Eric Frobish is an excellent attorney that we have worked with in a Guardianship case for the past three plus years. I found the above referenced law firm from the Internet. Upon the very first meeting, Eric was completely professional, honest and explained clearly what all was going to be involved in such an important case. This case was urgent, and had allot of unknowns and seemingly impossible odds against our ability to win. I am elated that after three years of sound advice and hard work on Eric Frobish’s part, we won the case. So many lives were impacted positively because of Eric’s knowledge of the law, his compassion for the children involved and experience. I honestly doubt that we could have won this case if it were any other lawyer in the area, other than Eric. He not only out maneuvered blatantly untrue attempts for us to lose, but brought in numerous witnesses to testify with facts to prove they were all untrue. Their was not one stone unturned. Eric guided us the entire duration and was absolutely impressive during the trial. We were so proud that Eric was representing us! There are no words that can express the gratitude we have towards Mr. Eric Frobish and his law firm. Everyone at the firm from the Lawyer, Assistants and the Secretary were nothing but courteous, polite and professional and I would highly recommend their services to anyone.
